Delivery Agreement - Leon's Heavy Equipment

Free Local Delivery

Leon’s Heavy Equipment offers free delivery within fifty (50) miles of its location, California location.

• Same-day delivery is available but subject to equipment availability and scheduling.

Extended Delivery

For deliveries beyond fifty (50) miles, the Buyer agrees to pay a delivery fee of $1.50 per mile (one-way).

• Long-distance deliveries must be scheduled in advance.

Customer Responsibilities

• The Buyer, or an authorized representative, must be present at the delivery location to accept the equipment.
• The Buyer is required to sign the invoice and delivery receipt upon arrival.
• If the Buyer fails to appear, refuses delivery, or refuses to sign documentation, the Buyer will be charged a $100 fee per fifty (50) miles driven.

Delivery Conditions

Delivery is limited to curbside, roadside, or driveway drop-off unless otherwise agreed in writing.

• The Buyer is solely responsible for ensuring that the delivery site is safe and accessible, including adequate space, ground conditions, and clearance.
• Leon’s Heavy Equipment shall not be held liable for any damage resulting from inaccessible or unsafe delivery conditions.

Weather & Traffic Delays

Deliveries may be delayed, rescheduled, or canceled without liability in the event of unsafe weather or hazardous road conditions.

• Deliveries may also be delayed due to traffic conditions, accidents, road closures, or other unforeseen circumstances beyond the control of Leon’s Heavy Equipment.
• Leon’s Heavy Equipment shall notify the Buyer promptly of any weather- or traffic-related changes to the delivery schedule.

Proof of Delivery

Leon’s Heavy Equipment reserves the right to take photographs and/or video recordings of the equipment at the time of delivery as proof of condition and successful handover.

• Such records may be used as evidence in the event of any disputes regarding condition or delivery acceptance.

Rescheduling & Cancellations

Deliveries must be rescheduled at least twenty-four (24) hours in advance.

• Cancellations made after equipment has been dispatched shall incur the applicable delivery fee.

Risk Transfer

Upon signature of the delivery receipt, or upon delivery to the Buyer’s designated location, all risk of loss, damage, and liability transfers to the Buyer.

• All sales are final, and equipment is sold “as-is, where-is,” with no warranties expressed or implied.
